Access to certain features of the Platform may require the creation of an account and prior acceptance of these Terms and Conditions.
By using Kinora Network, the user declares that they have read and understood these Terms and Conditions and agree to comply with them and with applicable law.

1.2. Definitions
For the purposes of these Terms and Conditions:
a) “Kinora Network”: the digital platform accessible through kinora.network and the features offered through it.
b) “Platform”: the website, applications or other interfaces through which Kinora Network services may be accessed.
c) “User”: any natural or legal person who accesses, registers with or uses the Platform.
d) “Account”: the individual space associated with a registered User.
e) “User Content”: any information, text, photograph, video, portfolio, document, project, opportunity, comment, link or other content added to the Platform by a User.

Kinora Network is a digital platform focused on the audiovisual and creative sectors whose purpose is to facilitate connections between professionals, students, creators, institutions, companies and other participants in the sector.
2.2. Features
The Platform may allow Users, among other things, to:
- a) create professional profiles and portfolios;
- b) discover professionals, companies, organisations and talent;
- c) create, publish or discover projects;
- d) publish or access job, internship, casting and collaboration opportunities;
- e) form teams and establish professional connections;
- f) use communication or interaction tools between Users.
2.3. Development of the Platform
Kinora Network is currently in an early-access and development phase. Accordingly, the features, characteristics and availability of the Services may evolve, change, be added or be withdrawn over time.
3. Registration and User Accounts
3.1. Registration Requirements
Access to certain features may require the creation of an Account and the provision of the information requested during the registration process.
Users agree to provide information that is accurate, up to date and sufficient.
3.2. Age and Legal Capacity
To create an Account on Kinora Network, Users must be at least 16 years old.
When registering, Users must provide their date of birth and confirm that the information provided is accurate.
Persons under the age of 16 may not create or use an Account on Kinora Network.
Kinora Network may take reasonable and proportionate measures to verify a User’s declared age where there are indications that such information may be inaccurate or where such verification is necessary for legal, security or user protection purposes.
For Users under the age of 18, Kinora Network may apply specific privacy, security, visibility, communication and interaction measures aimed at protecting minors when using the Platform.
3.3. Use of the Account
The Account is personal and the User is responsible for keeping their login credentials confidential.
Users may not:
- a) allow third parties to access their Account without authorisation;
- b) impersonate other persons or organisations;
- c) create Accounts using false or misleading information;
- d) access other Users’ Accounts without authorisation.
Users must notify Kinora Network of any unauthorised use or security incident of which they become aware.
4. Rules for Use of the Platform
4.1. Appropriate Use
Users agree to use Kinora Network lawfully, responsibly and with respect for the rights of third parties.
4.2. Prohibited Conduct
The Platform may not be used to:
- a) engage in unlawful, fraudulent or deceptive activities;
- b) publish deliberately false or misleading information;
- c) impersonate individuals, companies, institutions or other organisations;
- d) harass, threaten, discriminate against or harm other Users;
- e) publish content that infringes fundamental rights or promotes hatred, violence or discrimination;
- f) publish content that infringes third-party intellectual property, industrial property, privacy, image or data protection rights;
- g) distribute spam, unauthorised mass communications or malicious content;
- h) introduce viruses, malware or other elements capable of harming the Platform or third parties;
- i) attempt to gain unauthorised access to Kinora Network systems, data or Accounts, or those of other Users;
- j) extract, collect or reuse Platform data in an automated or large-scale manner without authorisation;
- k) use bots, scrapers or other automated systems unless expressly authorised;
- l) interfere with the normal operation or security of the Platform;
- m) use the Platform for purposes incompatible with its professional nature or with these Terms and Conditions.

5. Profiles, Projects, Opportunities and Other Content
5.1. Responsibility for Content
Users are responsible for the Content they publish or share through Kinora Network.
In particular, Users declare that they hold the necessary rights, permissions or authorisations to publish such Content.
5.2. Accuracy of Information
Profiles, CVs, portfolios, projects, opportunities, castings and other information published on the Platform must be reasonably accurate and must not contain false or misleading information about the relevant experience, identity, company, project or opportunity.
5.3. Third-Party Data
Users must not publish personal data, images or other information relating to third parties unless they have a lawful basis or the necessary authorisation to do so.
5.4. Visibility
Published information may be visible to other Users or publicly accessible depending on the characteristics of each feature and the privacy options selected by the User.
6. Projects and Professional Opportunities
6.1. Role of Kinora Network
Kinora Network provides tools that allow Users to publish, discover and connect around projects, jobs, internships, castings, collaborations and other professional opportunities.
Unless expressly stated otherwise, Kinora Network is not a party to any employment, commercial, academic or contractual relationship that may arise between Users or organisations connected through the Platform.
6.2. Responsibility of Users
The parties involved are responsible for verifying the conditions of each project or opportunity and for complying with any applicable employment, tax, contractual, administrative or other obligations.
6.3. Publication of Opportunities
Persons or organisations publishing opportunities are responsible for ensuring that the information provided is accurate, sufficient and compliant with applicable law.
Fraudulent, discriminatory or unlawful opportunities, or opportunities that may place Users at risk, may not be published.
7. Intellectual and Industrial Property
7.1. Kinora Network Content
The rights relating to the design, software, texts, logos, trademarks, interfaces, databases and other proprietary content of Kinora Network belong to its owner or the relevant licensors.
Use of the Platform does not grant Users any ownership rights over these elements.
7.2. User Content
Users retain ownership of any rights that apply to the content they publish on Kinora Network.
By publishing Content, Users grant Kinora Network a non-exclusive authorisation limited to what is necessary to host, technically reproduce, display and make such Content available within the Platform and provide the requested features.
This authorisation will end when the Content is deleted or the Account is removed, without prejudice to copies that may need to be retained temporarily for technical or legal reasons.
7.3. Third-Party Content
The publication of Content on Kinora Network does not mean that Kinora owns that Content or authorises its use outside the features of the Platform.
8. Content Moderation and Account Measures
8.1. Moderation
Kinora Network may take action when it becomes aware of content or conduct that:
- a) breaches these Terms and Conditions;
- b) is allegedly unlawful;
- c) infringes third-party rights;
- d) compromises the security or integrity of the Platform;
- e) or may seriously harm other Users.
8.2. Available Measures
Depending on the nature and seriousness of the case, Kinora Network may:
- a) warn the User;
- b) limit the visibility of certain Content;
- c) remove or block Content;
- d) temporarily restrict certain features;
- e) temporarily suspend the Account;
- f) permanently terminate the Account;
- g) or take other necessary and proportionate measures.
8.3. Moderation Criteria
Where appropriate, Kinora Network may take into account factors such as:
- a) the nature and seriousness of the breach;
- b) any harm caused;
- c) repeated conduct;
- d) the context in which the conduct occurred;
- e) and obligations arising from applicable law.
8.4. Information About Measures Taken
Where required by applicable law, Kinora Network will inform the affected User of any restrictions imposed and the main reasons for them.

9. Suspension, Termination and Account Closure
9.1. Voluntary Account Closure
Users may stop using Kinora Network and request deletion of their Account through the mechanisms available on the Platform.
9.2. Suspension or Termination by Kinora Network
Kinora Network may restrict, suspend or terminate an Account where there is a legitimate reason, including:
- a) serious or repeated breach of these Terms and Conditions;
- b) fraudulent or unlawful use of the Platform;
- c) security risks;
- d) infringement of third-party rights;
- e) or compliance with a legal obligation or a request from a competent authority.
9.3. Effects of Account Closure
Deletion or termination of an Account will result in loss of access to the associated features, without prejudice to the retention of certain information where necessary in accordance with the Privacy Policy or applicable law.
10. Paid Services and Premium Features
10.1. Current Status
If Kinora Network introduces subscriptions, premium services, promotion of profiles or projects, commissions, payments or other paid features in the future, the applicable financial terms will be clearly communicated before purchase or subscription.
10.2. Minimum Information
When paid services are offered, this section must specify, among other matters:
- a) price and applicable taxes;
- b) characteristics of the service;
- c) payment method and means of payment;
- d) duration;
- e) automatic renewal, where applicable;
- f) cancellation procedure;
- g) refunds;
- h) right of withdrawal, where applicable;
- i) payment provider;
- j) and any applicable specific terms.
11. Availability and Changes to the Service
11.1. Availability
Kinora Network will seek to keep the Platform available and functioning correctly but cannot guarantee that the Service will be permanently available or free from errors.
Interruptions may occur as a result of maintenance, updates, technical incidents, force majeure events or actions by third parties.
11.2. Changes to Features
Kinora Network may modify, update or withdraw features where necessary for technical, security, legal, operational or project-development reasons.
Where a change significantly affects Users’ rights or use of the Services, Kinora Network will provide appropriate notice where required.
12. Liability
12.1. User Content
Kinora Network does not necessarily create or control information published by Users and does not generally guarantee its accuracy, truthfulness, quality or currency.
12.2. Relationships Between Users
Kinora Network facilitates connections between individuals, professionals and organisations but does not guarantee that any connection will result in employment, collaboration, a project, internship, casting or other professional relationship.
Relationships established between Users are the responsibility of the parties involved, except in relation to services provided directly by Kinora Network.
12.3. Availability of the Service
Kinora Network will not be liable for losses arising exclusively from interruptions, errors or unavailability that are not directly attributable to Kinora Network, without prejudice to liabilities that cannot legally be excluded.
12.4. Legal Limitations
Nothing in these Terms and Conditions excludes or limits any rights or liabilities that cannot lawfully be excluded or limited under applicable law.

Kinora Network does not control these services and is not generally responsible for their content, availability, policies or operation.

16. Applicable Law and Dispute Resolution
16.1. Applicable Law
These Terms and Conditions are governed by Spanish law, without prejudice to any mandatory rules that may apply.
16.2. Dispute Resolution
In the event of a dispute, the parties will, where possible, attempt to resolve it amicably before pursuing other remedies.
Where an amicable solution cannot be reached, the courts and tribunals having jurisdiction under applicable law will be competent.
This provision does not limit any rights granted to consumers or Users by applicable law.
17. General Provisions
17.1. Severability
If any provision of these Terms and Conditions is declared null, invalid or unenforceable, this will not affect the validity of the remaining provisions, insofar as legally possible.
17.2. No Waiver
Kinora Network’s failure to exercise any right recognised under these Terms and Conditions on a particular occasion will not constitute a waiver of that right.
